Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of Everway — including our website, web application, and mobile apps (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Everway.

2. The Service

Everway helps you organize travel by turning emails you forward into trip itineraries. When you create a trip, Everway assigns a private receiving address on the everway.ai domain. When you send or forward a message to that address, we process it to extract booking details — such as times, places, confirmation numbers, costs, and attachments — and add them to your trip.

Everway does not connect to your personal mailbox, does not require you to share email-provider passwords or inbox OAuth access for ordinary use, and is not a travel agency, airline, hotel, or booking platform. We do not sell flights, hotels, or insurance, and we do not guarantee availability, pricing, or travel outcomes.

Features may differ between Free and Pro plans and between web and mobile. We may add, change, or discontinue features with reasonable notice when a change is material to paying subscribers.

3. Eligibility and accounts

You must be at least 16 years old to use Everway. By using the Service you represent that you meet that age requirement and that the information you provide is accurate.

You may sign in with a one-time code sent to your email address, or through Google or Apple when those options are available. You are responsible for keeping access to that email address or provider account secure — anyone who controls it may be able to access your Everway account. If you sign in with Google or Apple, your use of that provider is also governed by its terms and privacy policy.

One person or entity should use one account. You may not share sign-in codes or sessions in a way that lets others impersonate you, and you must notify us promptly at support@team.everway.ai if you believe your account has been compromised.

4. Your content

"Your Content" means the emails, attachments, trip details, notes, profile information, and other materials you submit to Everway. Your Content remains yours. You grant Everway a worldwide, non-exclusive license to host, store, process, transmit, display, and create derivative works from Your Content solely as needed to operate, secure, and improve the Service — for example extracting itinerary items, geocoding addresses, showing trips to you and guests you invite, and powering features you enable such as checklists or AI assistant connections.

We do not sell Your Content. We do not use Your Content to train machine-learning models. You represent that you have the rights needed to forward and process the content you send us, and that Your Content is not unlawful, malicious, or infringing.

Do not forward content you are not allowed to share. You are responsible for obtaining any consents required when you invite guests or include other people's personal information in a trip.

5. Plans and billing

Free plan

The Free plan includes one active trip that you own. Deleting a trip does not restore the free slot. The Free plan is intended to run a single trip end to end; keeping multiple trips or past archives requires Pro.

Everway Pro

Everway Pro is a paid subscription (monthly or yearly) that unlocks additional features, which may include unlimited trips, group invites, offline access, the pre-travel checklist, free-cancellation reminder emails, a personal username inbox, and AI assistant connections. Current pricing is shown on our Pricing page and at checkout.

Subscriptions are billed through Stripe, renew automatically until cancelled, and can be managed or cancelled from your plan settings. Cancellation takes effect at the end of the current billing period. Unless required by law or stated otherwise at purchase, fees are non-refundable for the current period already paid.

If you cancel Pro or your subscription lapses, existing trip data generally remains available to view, and guests you already invited keep their access, but Pro-only capabilities pause — including creating additional trips beyond Free limits, new invites, offline access, checklist, cancellation reminders, and AI assistant connections — until you subscribe again.

We may change prices with notice before the change applies to your next renewal. Taxes may apply based on your location and Stripe's billing configuration.

6. Accuracy of extracted details

Everway uses automated extraction, including AI models, to read bookings. Extraction can be wrong, incomplete, delayed, or outdated when a supplier changes a reservation. Items that need attention may be flagged for review, but you must always confirm critical travel details — flight times, reservation dates, addresses, passenger names, and cancellation deadlines — against the original confirmation before you rely on them.

Free-cancellation reminders and similar notifications are convenience features based on dates we extract or you enter; they are not a guarantee that a cancellation will succeed with the supplier. Everway is an organizational tool and is not responsible for missed connections, incorrect bookings, denied boarding, lost refunds, or other travel losses.

7. Guests and sharing

On plans that support it, you may invite guests to view a trip. Guests see the shared itinerary according to the permissions we provide (typically view-only) and do not receive access to your account settings or full email inbox. You are responsible for choosing invitees carefully and for any content you choose to share with them.

8. AI assistants and integrations

Pro may allow you to connect third-party AI assistants or tools (for example over MCP) to act with your Everway permissions. Those tools are provided by third parties. You are responsible for reviewing what you authorize them to do, for the prompts you send, and for verifying any actions or advice they produce. Everway is not responsible for third-party assistants' behavior, availability, or data practices beyond the access you grant through Everway.

9. Acceptable use

You agree not to:

• Use trip addresses to receive bulk, automated, unsolicited, or unlawful mail.
• Probe, scan, or test the vulnerability of the Service, or attempt to bypass access controls.
• Access other users' accounts or trips without authorization.
• Interfere with or disrupt the Service, including by overloading inbound email or APIs.
• Upload malware, or content that is illegal, harassing, or infringes others' rights.
• Resell, white-label, or offer the Service to third parties without our written agreement.
• Use the Service to build a competing product by systematically scraping or copying it.
• Misrepresent your identity or affiliation when using Everway.

We may rate-limit, quarantine, or refuse mail or requests that appear abusive. Report security issues to support@team.everway.ai rather than exploiting them.

10. Third-party services

The Service depends on third parties such as cloud hosting, email delivery, payment processing, maps, analytics, and AI extraction providers. Third-party sites or apps you open from Everway (for example Google Maps, Apple Maps, Stripe Checkout, or an AI assistant) are governed by their own terms. Everway is not responsible for third-party services we do not control.

11. Intellectual property

Everway, including its software, branding, and documentation, is owned by us and our licensors. These Terms do not grant you any right to use our trademarks except as needed to identify your use of the Service. Feedback you send us may be used to improve Everway without obligation to you.

12. Suspension and termination

You may stop using Everway at any time and may request account deletion as described in the Privacy Policy. We may suspend or terminate access if you violate these Terms, if required by law, or if your use creates risk for the Service or other users. We will try to provide notice when practical. On termination, your right to use the Service ends, and we handle Your Content according to the Privacy Policy.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT EXTRACTED ITINERARY DATA WILL BE ACCURATE OR COMPLETE.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVERWAY AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR TRAVEL-RELATED LOSSES, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (B) FIFTY U.S. DOLLARS (US$50) IF YOU HAVE NOT PAID US.

Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the fullest extent permitted by law. Nothing in these Terms limits liability that cannot be limited by law.

15. Indemnity

You will defend and indemnify Everway and its operators against claims, damages, and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, your invitees' use where you are responsible, or your violation of these Terms or applicable law, except to the extent caused by our willful misconduct.

16. Changes to these Terms

We may update these Terms as the Service evolves. If a change is material, we will notify you by email before it takes effect. Continuing to use Everway after the effective date means you accept the updated Terms. If you do not agree, you must stop using the Service and may cancel any paid subscription as described above.

17. General

These Terms are the entire agreement between you and Everway regarding the Service and supersede prior agreements on the same subject. If a provision is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Sections that by their nature should survive termination (including ownership, disclaimers, limitations of liability, and indemnity) will survive.
